On 30 March 2022, the European Commission published its proposal for the Ecodesign for Sustainable Products Regulation (ESPR). The ESPR would replace the current Ecodesign Directive and extend its scope to all products. It aims to regulate all lifecycle environmental impacts not just energy performance, make products more durable, reparable, and recyclable by design, address the presence of harmful chemicals, prohibit the destruction of unsold goods, and require the disclosure and registration of certain information about the product in a Digital Product Passport (DPP).
Manufacturers will have to comply with new design and information requirements related to resource efficiency, circularity, substances of concern, and environmental performance. The ESPR would still have to be implemented through specific delegated acts, which usually take several years to be developed. Textiles, batteries, and consumer electronics are priority sectors for new requirements. Products subject to EPREL requirements might be exempt from the DPP.
The proposal is being discussed in the European Parliament and Council of the EU. In the Parliament, the ITRE, IMCO and ENVI Committees are on the file. In the Council, the file is discussed in the Energy, Environment, and Competitiveness formations. Final adoption and publication is expected in the second half of 2023 or later.
